The Vargo & Janson (V&J) website is provided to users for the purpose of assisting V&J in debt collecting and for the convenience of the user. By using the website and voluntarily providing information through the website you not only agree to these Terms of Conditions and Use, you also grant V&J permission to use the information provided to collect a debt. If you provide your email address and/or your mobile/cell phone to us, we may communicate with you via email or cell phone.
 
These Terms of Conditions and Use may be changed by V&J at any time without notice.
 
Other websites that may be listed or linked to this website are for the user’s convenience and are not under the control of V&J. Thus, V&J can make no representation concerning the content or use of those websites provided on this website. Use of this website and any websites linked to this one are entirely at your own risk.
 
The information, materials and links contained in this website are provided "as is." V&J does not warrant the accuracy, adequacy or availability of the information and materials provided on this website or linked websites and V&J expressly disclaims liability for errors or omissions contained in this website. No warranty of any kind, express, implied or statutory, including, but not limited to, the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information contained in this website or linked websites.
 
V&J shall not be liable for any special, indirect, incidental, consequential, exemplary, extra-contractual, punitive or economic damages of any kind whatsoever which may result from the use of, access to or inability to use this website. These Terms of Conditions and Use are governed by the laws of Colorado.
 
On-line Payment(s)
 
If you submit information via this website to make an Automated Clearing House (ACH) or Credit Card payment, you authorize V&J and its agents to deduct the amount you specify from your bank account or submit the payment to your credit card company.
 
If you submit information via this website to make an On-Line Check payment, you authorize V&J to deposit that check. All On-Line Checks are deposited on a weekly basis; therefore, ACH and Credit Card payments are faster. V&J will post payments that are submitted to this website within 2 business days to the outstanding account you specify. We will notify you in writing 7-10 days prior to a post-dated check or future ACH deduction to remind you to have sufficient funds available.
 
All payments returned due to non sufficient funds or no account found will incur a $20 fee. If an overpayment is made on an account, V&J will refund the overpayment within 60 business days.
 
Payment(s) Cancellation Procedure
 
Vargo & Janson reserves the right to cancel and/or not accept payments at any time for any reason including but not limited to non agreement of amount or overpayment. If we cancel payments, we will attempt to notify you within a reasonable time.
 
If you would like to cancel payments, requests must be made via the website, phone, fax, email or regular mail (contact us). Valid and complete information (e.g. name, address, V&J account number) must be provided. If invalid and/or incomplete information is provided, the request may be denied due to the inability to locate the scheduled payment(s) and/or the V&J account. Upon receipt of the request, V&J will cancel the payment(s) within a reasonable time (typically less than 3 business days) and notify you via the information you provided. However, if a payment(s) has been or is being processed, Vargo & Janson reserves the right to process and keep those payments. Vargo & Janson and its agents shall not be liable for any special, incidental, consequential, exemplary, extra–contractual, punitive or economic damages of any kind whatsoever for non-cancellation within the reasonable time allowed.
 
Payment(s) Modification
 
Vargo & Janson reserves the right to refuse any request to modify a scheduled payment other than cancellation. Vargo & Janson cannot and will not modify the payment(s) without your authority. However, Vargo & Janson can cancel any payment(s) (see Payment Cancellation Procedure).
 
There are two ways you may modify your payment:
 
  1. Request to cancel all payments or a specific payment by date via the process described in above (Payment Cancellation Procedure). Once cancelled, you can then submit new payments via the web.
  2. Signed authorization by the payer sent via fax or regular mail only (contact us). Vargo & Janson can NOT accept an email or phone call to modify your payments. Valid and complete information (e.g. name, address, V&J account number) must be provided. If invalid and/or incomplete information is provided, the request may be denied due to the inability to locate the scheduled payment(s) and/or the V&J account.

V&J's Privacy Notice and Policy is hereby incorporated into these Terms of Conditions and Use.
